1. Acceptance of Terms

By accessing or using My Cooking Assistant ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

My Cooking Assistant is a software-as-a-service application provided by Persistent Controls, LLC ("we," "us," or "our"). We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.

3. Account Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorized use.

4. Subscription and Payment

  • Paid plans are billed in advance on a recurring basis (monthly or annual).
  • All fees are non-refundable except as required by law or expressly stated herein.
  • We may change pricing with 30 days' notice. Continued use after the notice period constitutes acceptance.
  • Failure to pay may result in suspension or termination of your account.

5. Acceptable Use

You agree not to:

  • Violate any applicable law or regulation
  • Reverse engineer, decompile, or attempt to extract source code
  • Use the Service to transmit malware, spam, or harmful content
  • Resell or sublicense the Service without written consent
  • Interfere with or disrupt the integrity or performance of the Service

6. Intellectual Property

We retain all rights, title, and interest in the Service, including all software, designs, and content. These Terms do not grant you any ownership rights. Your data remains yours; you grant us a limited license to process it solely to provide the Service.

7. Data and Privacy

Our Privacy Policy governs how we collect and use your data, and is incorporated into these Terms by reference. By using the Service, you consent to that policy.

8. Termination

Either party may terminate at any time. Upon termination, your right to access the Service ceases immediately. We may retain your data for a reasonable period before deletion, as described in our Privacy Policy.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

11. Indemnification

You agree to indemnify and hold harmless Persistent Controls, LLC and its officers, directors, employees, and agents from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

12. Governing Law

These Terms are governed by the laws of Minnesota, without regard to conflict of law principles. Any disputes shall be resolved in the District Courts of Minnesota.

13. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via email or in-app notice at least 14 days before taking effect. Continued use constitutes acceptance.
